[/quote] Okay fair point she could somehow get it off the phone, but I think there would be doubt here if defense asserted that without any other evidence than what we have so far. Among other things. I’m in full agreement that Brendan used the knife on Christine. We also had a line of discussion about whether it was more accurate to say she was stabbed rather than cut. I think potentially cut is more accurate, so I mean Joe did go with the intention of doing that (as set up by the actual murderer). I actually disagree and think the forensic evidence was a bit weaker than I would have liked, just a little underwhelming. If you told me that before seeing the CW’s whole case I would have been more disbelieving of that because it seems super hard to stage this and was a chaotic scene. But we know the CW had a relatively hard time bringing him down. So that isn’t supportive of so much forensic evidence making it obvious Brendan used the knife. I think the best evidence from the actual murder scene is the 911 hang up call, honestly. It establishes that someone was shot well before they actually called 911 to have help dispatched. And I think Juliana’s testimony with respect to the catfish theory is pretty key to the CW case against Brendan. That is why they were so willing to come to the table for her proffer. [/quote]
