The defense overall argument based on opening is that the catfishing is a “theory” which was developed by investigators and then to receive a deal, Juliana read the discovery and went along with it. According to the defense, this theory caused a schism within the original investigative team which led to officers being reassigned (this seems to be true, at least for one investigator, but he is the one who testified yesterday and said in the context of the codefendant’s cooperation he would have different conclusions). This is just the best avenue the defense has to create reasonable doubt. [/quote]
