There are lots of reasons why cases don't get prosecuted, often because the original victim or witnesses can't be found or don't want to testify. And we don't lock up people for life for public intoxication (which in a lot of places is not a crime, only public consumption is)m trespassing, or larceny. And 3 strikes laws turn out to be a bad idea. I looked up his name, and cases were in fact dropped due to lack of witness or victim testimony. The article says there was no record of contact attempts and no subpoenas were issued, which then becomes a question of how the office and/or law enforcement are prioritizing cases, staying on top of workloads, etc. We live in a world were rape kits sit without being processed for years, so. . . [/quote] In this case, the police specifically told Descano’s office that this man was violent and escalating, and it was only a matter of time before he hurt someone or worse. Descano’s office chose not to prosecute him for previous crimes, nor help get him deported as he is here illegally. And this is one of multiple cases where Descano’s office has declined to prosecute violent offenders. This isn’t a one-off, it’s a pattern. [/quote]
