I mean, if you were able to avoid the collision because you were paying attention to the road, but the distracted mom doesn’t see it, shouldn’t she bear some blame for the negligent driving? It’s not like it was impossible to see and avoid the 18-wheeler, since you did it.[/quote]

Except she bears all the responsibility. She is the one in care and control of her car. If she is that easily distracted that she cannot drive safely she should not have children in the car. [/quote]
