So once Roe falls, could a group of Jewish people file a class action suit against Mississippi for religious discrimination? That the health and well-being of the mother cannot be superseded by a 8 week fetus per their religion, and therefore a law that goes against their religious beliefs and puts women’s health and week-being at risk is religious discrimination?
I believe so. Long standing Talmudic readings stipulate that the woman's life takes precedence over the unborn fetus and that the fetus is not a "life" until the moment of birth. However, a few politically conservative Orthodox groups have come out in favor of the Republicans' actions. But this really isn't a long-standing belief and is instead a craven political move.
While I totally believe that what is described is unconstitutional, here’s the problem: who would ultimately hear such a case? Yes, the same Supreme Court that has acted unconstitutionally in imposing their religious beliefs on the rest of us. Sadly, we no longer have a Supreme Court that will uphold the rights of other religions and of those who are not wealthy.
It would in fact go back to the Supreme Court. But I say, force them to rule against the 1st Amendment rights of other religions in America. Put their hypocrisy and degenerate enslavement to radical Christianity in full view for everyone to see. Put them in the difficult position of having to effectively endorse a state religion. Their legitimacy will fall faster and faster and their names will forever become dirty words in the annals of history.
