So once Roe falls, could a group of Jewish people file a class action suit against Mississippi for religious discrimination? That the health and well-being of the mother cannot be superseded by a 8 week fetus per their religion, and therefore a law that goes against their religious beliefs and puts women’s health and week-being at risk is religious discrimination?
I believe so. Long standing Talmudic readings stipulate that the woman's life takes precedence over the unborn fetus and that the fetus is not a "life" until the moment of birth. However, a few politically conservative Orthodox groups have come out in favor of the Republicans' actions. But this really isn't a long-standing belief and is instead a craven political move.
While I totally believe that what is described is unconstitutional, here’s the problem: who would ultimately hear such a case? Yes, the same Supreme Court that has acted unconstitutionally in imposing their religious beliefs on the rest of us. Sadly, we no longer have a Supreme Court that will uphold the rights of other religions and of those who are not wealthy.
