Remember he's more of a partisan hack than a true believer like the other four. Either Roberts is trying to pull him away for a compromise opinion (Roberts wants to allow the MO restrictions but keep Roe) or Ginni Thomas is trying to keep him on board.[/quote] NP here: agreed. I think this leak is coming out of the chambers of one of the Republican-appointed justices. Either to keep a wavering justice in line or to sway someone to a more moderated view. Democratic-appointed justices don't gain much from leaking this. Better to have let the final decision drop like a neutron bomb this summer, closer to the date of the midterms. [/quote] The liberal justices don’t want Alito’s decision issued at all. They would rather see a pared back version that still preserves Roe (since they know they’re not going to get the Court to go completely the other way on this case). If they can’t accomplish that, then any value Democrats might get from this in November (which is still very speculative) would only be a consolation prize. [/quote]
