I don't know enough about it but I believe the reasoning is, they didn't think they'd have a strong enough case without her testimony.  Brendan could say that the Au Pair did it (if he didn't want to stick with his self defense against Joe defense plan), and she could say that he did it, and there would be enough reasonable doubt to clear them both.
