Background checks are fine but needs to be an extremely high threshold to infringe upon the constitutional right.
How do you define "extremely high threshold"?
Convicted of a violent felony. Currently diagnosed with a mental illness scientifically associated with a proclivity to perform violent acts.
How about the Terror Watch List? And should background checks be required at gun shows? Online classified?
They are already required for all FFL sales whether it is at a gun show or not. I believe you are thinking of private sales.
Yes. Private sales by unlicensed sellers at gun shows or via online classified ads.
I don't want to be an FFL. I'm not in the business of selling guns, I'm a collector and trader of them. This isn't a commercial venture for me, and I shouldn't need a commercial license to be able to request a background check on someone without having to pay a FFL dealer to do a transfer for me. Because even if the buyer is paying for it, that money still comes as a loss to me since it's a factor in what someone is willing to pay. I don't want to involve an FFL in a transaction that they have no involvement in and haven't facilitated in any way other than padding their own pocket. The dems in congress could solve this private sale problem of yours instantly by passing a bill that will allow private citizens access to the NICS system that licensed dealers use. Right now, I'm prohibited by federal law from calling NICS and asking them to run a background check on a person I would sell/trade a gun from my collection to. Do you get that? It's ILLEGAL for me to call the National Instant Check System phone number and request a background check on a prospective buyer. Why? Why in God's name should it be illegal for me to use the NICS process to check a buyer? Why is NICS only available to dealers? Why? What sense does this make? And why have democrats done NOTHING to change it?
One problem. The Ds in the House can’t pass a bill without the Rs in the Senate. McConnell is already sitting on hundreds of bills passed by the House. Push this with your congresspeople next year when that problem is hopefully fixed. In the meantime get an FFL yourself.
