If the e-bike and the truck arrived at the intersection at the same time and the e-bike is going straight, the e-bike has the right of way. As was noted earlier, there is even a bright yellow sign on Kansas at that intersection instructing drivers to give way to cyclists and pedestrians. There is only one scenario in which the crash is not the drivers fault and that was if the cyclist(s) had been essentially hiding behind the truck and then jumped out on the right side just as the truck was turning. In any other scenario, the driver should have been well aware (either by checking their right mirror or by having passed the cyclist) that the cyclist was on their right and given way to them as they are explicitly instructed to do. But we don’t know exactly what happened and so I am not going to blame either party for the crash until I get more facts. It’s appalling and disgusting how eager some of y’all are to manifest baseless assumptions to justify your desperate need to believe that any cyclist who is killed must be responsible for their own death.[/quote]
