There are some crazy scenarios where you could charge someone with felony murder. For example, you and I go rob a gas station. I bring a water pistol and you bring a real gun. You shoot at the clerk and miss. The clerk blows you away. I go to jail for the rest of my life because the dumb law says so. I think most people would agree that you are responsible for your own death. I am (or should be) guilty of armed robbery, a much lesser charge.[/quote] That’s not a dumb outcome at all. In that scenario, you intentionally engaged in criminal conduct that resulted in a death, and that potential outcome was entirely foreseeable. The felony murder rule is a good rule. Obviously, whether the cameraman is guilty depends on the specific facts, but it’s not a surprise that they were charged.[/quote] +1. Also, if there are indeed texts or FB messages between this guy/the McMichaels/other neighbors talking about stopping this guy, it may be more than felony murder.[/quote] Agree, but I don’t think they intended to kill him on purpose when they set things up—i know some people think that, but to me it seems a lot more likely that they actually (and perhaps incorrectly) really did think he was a burglar and actually intended to execute their half-baked citizens arrest—so I expect there will be a lot of debate on the facts potentially supporting felony murder here. You might have to charge like kidnapping or something. If I was the prosecutor, I would charge it to try to get the videographer to flip, which will make it a lot easier to convict the shooter of something more serious IMO. Note—while I think the “intentional hunting of innocent black youth” formulation is pretty implausible, and that it would be a major mistake to prosecute here on that theory of the case, I think that the shooters are very likely guilty of some form of criminal homicide and are going to jail.
