He's not only a Supreme Court Justice. He's also a citizen.

He can fly whatever the hell he wants to.  I for one am happy he's exercising his first amendment rights.

Oh yes he can.  He signs away no rights as a U.S. citizen when entering SCOTUS.  You would like to think otherwise, but no.

DP. Of course he can do anything he wants. But it’s about appearances and ethics and what he did is highly inappropriate because he is a SC judge. If you or your neighbor fly a confederate flag, just as an example, it may raise eyebrows but won’t have any real consequences since you are ordinary citizens. A SC justice should not reveal his biases so publicly. [/quote]

And, as we have learned..... it was his wife who flew the upside down flag.  Alito himself had nothing to do with that. 
And, the faux outrage about "Appeal to Heaven" flag is just a desperate ploy on the part of the left.
