For the 100th time, unlawful presence in the US is a CIVIL violation, not a crime. What IS a criminal offense is entering illegally (crossing a border without inspection). But, even then, first-time illegal entry is usually a misdemeanor (a minor crime).

Not true for everyone:

*Many states give driver's licenses to undocumented people without requiring fake documents (they use special rules or ITINs).  
*Public schools must enroll children regardless of immigration status—no fraud needed (Supreme Court ruling).  
*Some public services (emergency care, K-12 education) do not require proof of legal status.  
*Loans and public benefits often DO require legal status or valid ID, so many undocumented people cannot get them at all.
