is this groping or sexual assault why down play it
Good question for the prosecutor.
Isn't unwanted groping sexual assault?
To me it is definitely a degree of sexual assault, but the Virginia Code definitions of sexual assault would come into play regarding what the police could charge. Sometimes something can be charged as a lessor crime because the evidence to convict is better and the more serious crime hard to prove. Sexual assault can be really tough because often times the victims can be reluctant to testify. I could see in a case like this the young women not wanting to testify because the defense attorney will likely make comments like revealing clothes or that she didn't immediately call out stop touching me or didn't immediately run to the office. I hope we get a decent investigation and that the principal who otherwise appears to be a great principal isn't just made a scapegoat.
