US citizens are not required to carry proof of citizenship. However, it’s not a bad idea these days. CBP claims the right to stop anyone without needing probable cause or reasonable suspicion for a 100-mile border zone. The zone covers a wide swath of the US, including the DMV. CBP can ask you about your citizenship during a stop. Although there is no requirement to prove it, I would not mess with this in the current environment. Not all states include citizenship on the REAL ID. Get a passport card. Anyone who is here legally and is not a citizen should be carrying proof that they are in the US legally. A summary of the legal basis for these stops is here: https://www.aclutx.org/en/know-your-rights/border-pocket-guide The posters upthread saying they will sue if they are stopped—good luck with that in this environment.
Yes true but there are many news stories about ICE picking up citizens (particularly Hispanic ones) and placing them in detention for days despite the citizen insisting they’re a citizen until someone calls a lawyer to get them out. No one wants to take a risk in this “shoot first, ask questions later” environment, particularly for kids.
