You rear-end someone in front of you, it’s because you didn’t leave adequate distance. Period. If someone gets in front of you, it’s your responsibility to create enough distance again to allow you avoid hitting them in a panic stop.

I've been driving down the road, in the right side lane, with my turn signals indicating that I'm about to turn right when someone speeds passed me on my left cutting me off and slamming on their brakes so they can make that right turn in front on me. That can't be my fault if I rear end them. [/quote]
