If you went in to a criminal defense attorney to talk about her representing you for a DUI or whatever, and they turned you down as a client because they were too busy, the initial discussion would still be privileged. When someone comes to a person they know is a lawyer and says “I’m in trouble”, even if that lawyer does not end up representing them, the chances of that discussion being allowed in court are exceedingly slim. [/quote] Exactly. The test is essentially whether they knew you were a lawyer and they said things to you in furthering assistance. Essentially. The requirement of a monetary exchange makes for good television though. [/quote]
