It gets complicated. In FL for example, if you die intestate and spouse is not on the deed, property passes to the children, while the spouse has a living will, which allows spouse to stay in the home until death. Kids can’t sell step-mother’s home out from under her, and she doesn’t own the asset. [/quote]
