Per the FVRa, acting appointments for positions that must be approved by the Senate can only be acting for 210 days. Chad Wolf was appointed in November 2019, over a year ago. Since mid-June, he has exceeded that term and the head of DHS is supposed to remain vacant until a presidentially appointed and Senate confirmed candidate is approved as a replacement.
