No.  Whether or not you believe that his appointment was illegal or not there is no question that he is currently serving illegally.  Per the FVRa, acting appointments for positions that must be approved by the Senate can only be acting for 210 days.  Chad Wolf was appointed in November 2019, over a year ago.  Since mid-June, he has exceeded that term and the head of DHS is supposed to remain vacant until a presidentially appointed and Senate confirmed candidate is approved as a replacement.

As for his appointment, a federal judge does disagree with you.
