The only thing I can think of is that his phone was legit hacked and she wasn't involved. Her brother definitely spilled the beans about the affair, but the proof came from a 3rd party hacking his phone.

You must have missed the news. Prosecutors in NY have definitive forensic evidence that she sent the pictures to her brother and he to National Enquirer. That's what makes the engagement news baffling, it comes right after these revelations.
