OP if you never divorce it would depend on how you do your will or trust. If he dies first I would imagine it would go to you and vise versa. Homes are mostly titled right of survivorship meaning the title transfers right to the surviving spouse. If you have questions you should talk to an estate attorney. Otherwise, this child poses no threat. If that's your concern.
