[/quote] He may well be but Rutherford did some screwy things that really messed that case up for her. They divorced while she was pregnant and when the child was born, she didn't put the father's name down on the birth certificate and failed to inform him of the birth. She also (!!!) reported him to the INS and alleged Patriot act violations, resulting in him losing his US visa temporarily (this decision was later reversed based on insufficient evidence). The court in that case viewed these acts as effort to alienate the father from his children by preventing him for seeing them altogether. That's a BIG no-no in a custody battle. The court believed that if Rutherford was awarded custody, she'd attempt to prevent their father from seeing them at all. So instead he got full custody and she got extensive visitation rights as well as the right to contribute to major parenting decisions such as their education, health, etc. There is zero evidence that Turner has been trying to prevent Joe from having access to their kids. In fact the kids have largely been with Jonas since he filed for divorce and she only took custody a couple days ago. If her allegations that he removed the kids from the UK without her permission, or that he had previously agreed to take the kids to the UK so she could see them this week and then didn't, it is Sophie who would have a stronger case for parental alienation, not Joe.
