FSTs are the easiest thing to get tossed in court because they rely on officer judgement. I did not hear Woods slurring his words in those videos. He appeared to be capable of completing the hand-eye coordination tests. FSTs are meant for you to fail. Some of the tasks are difficult for non-impaired and health individuals. People with chronic injuries or having just been in a car accident? You're going to fail a FST. Woods was not evaluated by a medical professional - if he had a head injury, he would not be in a reasonable state of mind to consent to anything. His first mistake was even agreeing to do a FST after an accident as did not know the potential extent of his own injuries. If Woods has an RX for the pills, he will be fine. I would also deny the blood/piss test in the station. Why give anyone more evidence? He did the right thing from a personal legal standpoint. He will lose his license for a year, but will have the charges dismissed. [/quote]
