"11. GDS putatively gained millions of dollars of revenue from the overenrollment." The operative word is revenue, not profit. What were the added expenses caused by overenrollment? Where does/did the surplus (revenue minus expenses) go? The ANC's chair is distorting reality, perhaps intentionally, perhaps ignorantly. GDS is a non-profit, not a private company. I suspect that if there has been any surplus, much of it has been/will be earmarked for scholarships to those with financial need. It beggars belief that GDS is nefarious. "12. If GDS is not held accountable it would be incentivized to repeat its misconduct and would set an example for other schools like it, such as the River School. The extra car trips generated would impose harm on the residents of the ANC and the broader environment by, among other things, contributing to congestion, danger to pedestrians, and climate change." This statement is irrational. Enrolling 50 more students does not create more climate change, unless one can prove that the average driving distance to GDS is higher than the average of the cumulative distances to the schools these children would have otherwise attended. "Danger to pedestrians?" Show the proof that this is the case, rather than just accuse. I don't think you can. To describe GDS as "misconduct", and as a corollary malevolence is just not credible. GDS made a mistake, and it has admitted as such, repeatedly. Why not read its mistake generously and sit down at the table and resolve the issue rather than threatening lawsuits and heavy fines. To do otherwise is to act in bad faith. Litigiousness rather than citizen diplomacy just creates further mistrust. #13: I guess this is your "smoking gun" of malicious intent. That accusation seems rather puerile to me: the ANC found the omission and brought it up. I suspect that the amendment wasn't redlined, because it is an amendment, not an edited version of the main document. All I can say is that after watching the video, GDS HOS, Russ Shaw, comes across as a person dedicated to his school and Tenleytown. I just don't believe he is trying to pull the wool over anyone's eyes.
