Because while he remains under the presumption of innocence, he has legal custody of his daughter and thus the right to determine with whom and where she will live while he is indisposed pending trial. He might get out on bail and continue to primary parent her, who knows. At some point if the mother’s family can make a showing that the paternal grandmother is unfit then maybe they get custody.[/quote]

They can file for an immediate custody hearing. He’s in jail, indicted for double murder. So his custody can be taken. Either side can file. If his mother has the daughter right now she should be filing too. I’d like to find a family court judge that upholds the father’s “right to determine with whom and where she lives”. There is actual case law on this issue.[/quote]
