Whether technically an “assault” or not, no DC jury was ever going to convict a man for throwing a sandwich at a border patrol agent when protesting Trump’s immigration policy. But an element of assault in DC is that it actually has to be an attempt to cause an injury with the ability to carry out the injury. Throwing a sandwich may not meet that standard.
