OK, I did not say that it is not illegal.  I think it [i]probably[/i] was illegal and that Z should spend the rest of his life in jail.

That being said, we do not know everything.  There are circumstance that could be true under which shooting the unarmed boy would not qualify as murder.  For example, if Z stopped chasing T and decided to return to his vehicle.  If T then decided that he did not like the harassment and was going to take a stand and then pursued Z.  If T then attacked  Z and got the better of Z.  Then, the doctrine would apply. [b] The fact that Z was wholly and completely wrong to pursue T does not then mean that the defense is unavailable to him.[/b]
The guy was apparently bleeding from his nose and back of his head.  This is enough evidence to [i]leave open the possibility[/i] that Z was losing an intense fight and feared for his life.

Well, sure. Defense lawyers can make lots of arguments and interpret the law in any way they want.  Doesn't mean a jury will buy it.
