You are right that an agency can stop finalization for a domestic adoption, because in domestic adoption there's a period of time between placement and finalization. In this case, the adoption was finalized in China, at which point she wasn't pregnant. [/quote] Of course it was finalized in China but they had to have a home study and agency here. Most families also do a readoption in the US to make sure its not an issue with citizenship in the future. [/quote] Actually they can and older kids are placed for adoption via private agencies, its rare but it happens. A private agency, if they have foster homes, can place a child in foster care prior to adoption. But, this was probably done in a shady way under the table without a home study or agency. If the kid is lucky, they used a lawyer but otherwise often the kids are just handed over to the new family, no home study, nothing and either a POA or something else. Or, really the kids should go into government foster care. [/quote] I'm not sure, but it seems like we're talking about different things. A private agency can absolutely take custody of a child that is surrendered by his or her parents, whether birth or adoptive. But are you saying that if an adoption agency finds out about something that a parent does that may be bad judgement but isn't illegal or abusive, like getting pregnant a year after bringing home a high needs child, that they can remove the child, after finalization, against the parent's will? I agree with you 100% that there needs to be government and agency oversight into these transfers. I hope that is what happened here. [/quote]
