Justice Kennedy voted to uphold that precedent years later. [/quote] Oh, I am aware that it was Roe v Wade but the focus on judicial philosophy and how issues dear to each side would be determined is why we ended up with Garland not being given a hearing. The Republicans wanted Scalia's seat to be filled by a conservative because there were issues important to them that they did not want to leave to the mercy of liberal Supreme court.[/quote]
