The administration has funded 10,000 new ICE officers – the largest personnel increase in agency history – and is using I-9 audits not just for civil penalties but to identify unauthorized workers for removal and pursue criminal charges against employers. This enforcement surge is welcome – but it exposes a fundamental gap in the law. Employers are still only required to visually inspect work authorization documents at the point of hire. They are not required to verify those documents against government records. That gap is why illegal hiring persists even under the most aggressive enforcement campaign in memory – and it is exactly what mandatory E-Verify would close. Penn Wharton estimates that mandatory E-Verify would raise wages for authorized workers by 5%.
