They, the department and the City have significant exposure in this case. The mere alleged absence of evidence for w lawful stop at this point, when the full investigation is in its early stages, does not mean there is no evidence or that the stop was not lawful. The insistence that the accused produce evidence of a lawful stop turns the burden of proof on its head. If part of the alleged offenses of the accused is that the stop was not lawful it is for the authorities to prove that, not for the accused to disprove it in the first instance. [/quote]
