Ummm... This is a federal requirement. FCPS doesn't follow the law, they lose a ton of $$-- Title I & IDEA funds come to mind. But that's just the start. So: serious question before I sign. What is the plan to make this money up after FCPS gives the federal government the middle finger?
Ummm... no it's not. Parts of the admin are using a new definition of sex to make this point, but pointedly deny this definition can be used for Title IX. The courts will ultimately decide the definition of sex, and it will have to be consistent for Title I and IX, probably no one will be happy. If gender is fluid and not biological, then woman's sports are in for a major change.
Ummmm... Yes it is. Or are you the idiot who starts petitions (with bad grammar) and doesn't both to learn the facts: http://www.transequality.org/know-your-rights/schools
Not the OP. But I have studied the facts, which are not addressed in your link. The unintended consequences of this ill thought out policy will certainly be a challenge. DOE and one lower level court in Texas have advocated that the term "discrimination based on sex" as described in Title I must not be strictly interpreted based on biological sex. That an individuals sex must be respected based on whichever sex they choose to be and that it is unreasonable to ask for any legal, medical, or other documentation. An individuals sex is simply what the individual claims it to be. If this precedent survives, the same definition must apply to Title IX as well. It will be a mess.
Okay. This is gibberish. And what some future Court might do down the road is irrelevant to what the law is now. So again-- what is the plan to replace the federal funds that would be pulled next year if FCPS did what you ask? Because under the law, as it stands, federal funding would be pulled. (Also, we are in the 4th Circuit. What a federal Court does in Texas does not apply to us unless/until the Supreme Court signs off. And it would take several years of no federal funding to reach the Supremes). I imagine Title I schools care a lot about the reading specialists they would lose and have little patience for made up problems from hate based fear mongerers.
