[/quote] I know a judge who signed off on a divorce decree dividing up the house because of financial reasons (i.e. H will reside in this bedroom, W in this, shared kitchen etc.). So at the stage of separation, it absolutely can happen but it's harder to prove. You'd have to actually prove it rather than it being presumed because of living arrangements. Having sex though?
