Send him a copy of this thread and say you've been advised by many counsel that HE, the landlord, was supposed to remit the security deposit at the 30 day mark along with an itemized (with documentation of actual expenses paid) list of costs for actual repair (I usually include photographs when doing this). He failed to do that. So he is in default and you can sue. Tell him he has four days in which to return to you the full amount of security deposit after which if he fails you will turn over to the Attorney General of the State of VA (they can route it to the appropriate office). That should get sufficient action out of him if they are smart. Professional landlords all know these rules.
God please don't do that. He's wrong and you should definitely sue but don't send him an internet thread and tell him that's the basis for your belief! Also, you can try the AG's office but I wouldn't count on them pursuing this. Unfortunately they just don't have the resources to right every wrong.
I won't send him this thread lol. I think at this point, my only option would be to sue and deal with taking a day off @ work, going to the Loudoun County courts to settle this, ughhhh such a waste of everybody's time for $150!!!! I really wish it didn't have to come to this
