I would not call CPS unless you think the child is being abused and you have actual evidence to back up your accusation. You don't want to add fuel to the fire or endanger the baby any further. Do tell BIL that the baby's welfare must come before the mom's welfare. He must protect the baby at all costs, even if that means removing the baby from his home, divorcing SIL, whatever it takes. If and only if BIL does not take steps to remedy the situation and protect the baby, then you can call the police. But make sure you have strong evidence, and that you are willing to accept the consequences. You and your DH are not likely to have a relationship with BIL and SIL ever again.
Huh? How is hitting a 9 month old NOT abuse??? This isn't some "gray" area. OP--call CPS. I am a school principal who has called many times. Not every call results in an investigation. Explain what you know. They will decide whether to pick up the case. CPS has access to services that will help this family. At the end of the day, I need to be able to look at myself in the mirror and know I did everything I could to protect a child. It doesn't matter who it upsets. The child's safety trumps all of that. And this will always be one of those situations where you have to err on the side of making a mistake. Make the call.
