Clayton County decision, in which the U.S. Supreme Court deemed they were included in sex discrimination protections. In another test of the high court, Bulso’s HB 1473, Bulso takes on Obergefell v. Hodges, the landmark 2015 ruling that granted same-sex couples the right to marry. The bill would build on a 2024 state law allowing public officials to refuse to perform marriages that go against their beliefs and the state’s previous language defining marriage as between one man and one woman, which was nullified by Obergefell. “Private citizens and organizations are not bound by the Fourteenth Amendment or by the Supreme Court’s purported interpretation of the Fourteenth Amendment in Obergefell v. Hodges, 576 U.S. 644 (2015), and no private citizen or organization in this state is required to recognize a marriage or a purported marriage between individuals of the same sex, notwithstanding any other law,” the proposed bill reads. The third bill, HB 1474, is titled the “No Pride Flag or Month Act” would ban pride flags, rainbow flags, the equality flag or “any object, image, or representation that uses the word ‘pride’ in a manner intended to convey support for or approval of lesbianism, homosexuality, bisexuality, transgenderism, gender non-conforming behavior, or individuals who engage in such conduct” on state property and would similarly prohibit any action that recognizes Pride month.
