I think what people are trying to explain to you is that if you don’t carefully write the language around what a tip is and/or limit the benefit to those with an income lower than what a high earning waiter makes, executives will ABSOLUTELY get in line to use whatever verbiage ends up in the bill to redefine their bonuses so they don’t get taxed.

This I am a non-exempt employee, so I earn OT, but my base salary is also close to $150K, bring on the no tax on OT, will they also exempt tax my 40K~ bonuses. I don't work a ton of OT anymore, but there was a time when I brought home an extra $30~ a month before taxes in OT/differential pay. I would have loved to not be taxed on that OT.

I'm sure it will never happen, but if it did. I wouldn't be arguing against it. [/quote]
