Don't understand why 3 & 5 y/o can't share a room. They'd probably prefer it and might even be too scared to sleep in their own spaces anyway. You have about 4 years before both of your boys are of age....perfect timing for when your ex-husband's youngest kids will need to be in separate rooms.

BTW, aren't there laws that prohibit the sharing of rooms for opposite-sex siblings after a certain age?

I personally would not allow my children to stay overnight until this matter was cleared up (if they've already moved). I'd also confirm that this is a finished basement that is being considered for bedroom space. [/quote]
