[/quote] A person pulling out does not have the right of way. A person pulling in from a lane does have the right of way in that lane. So the person who attempted to pass another car that was currently occupying the lane would be at fault, because they did not have the right of way. Yes, someone parking needs to watch where they are going, but that's not the same as legal fault or responsibility. [/quote]
