Its part of his military pension so he cannot fight it even though she was only with him the 10 years not 20 he was in.[/quote] The federal retirement system is a different thing than court ordered alimony... when on active duty we saw a lot of divorces happen RIGHT before that magic 10 year number (or right after, when the spouse was basically guaranteed a portion of it for life if the service member/federal employee retired out of the federal system). It happens in the federal system as well - we had a good friend who is a Fed employee go through a divorce (no children) and her husband was at fault- she still had to buy him out of her retirement (get him to sign paperwork to waive his rights to half of her retirement).
