The grand jury is just seeing if the state has enough to charge the defendant. They do not even consider guilt/innocence. And the ADA can come back to the grand jury as many times as they want. For example, an ADA may present to the grand jury, then the GJ has a bunch of questions for the ADA. Each juror asks questions directly. This may cause the ADA to step back and realize they do not have a strong enough case to get indictment. So they go back to the detectives, scene, etc and develop a stronger case. Then they re-present to the GJ at a later date(they try to present to the same GJ, which is why many serve for on day a week for months at a time). Charges can be added/dropped/changed, defendants can be added/dropped/changed. So no a GJ is not a rubber stamp. However, if you have unlimited chances to build a case and secure a vote, then the likelihood of getting an indictment increases. [/quote]
