+1 I wonder why there was never a state prosecution based on the simpler charges of assault etc. Seems like more of a slam dunk and easier for jurors to understand.[/quote]

Like my AP English teacher always said, (state prosecutors) need to Answer the Question Being Asked. Which here is the charges they chose.

If they failed to do that they failed.
