Major Trump-Era Restrictions on Legal Immigration

1. Public Charge Rule (2019)
The administration expanded the definition of “public charge,” making it harder for immigrants who had used or were likely to use certain public benefits to obtain green cards or visas. This had a chilling effect far beyond the actual denial numbers.

2. Travel Ban
Trump restricted entry from several predominantly Muslim-majority countries through a series of executive orders and proclamations, upheld in part by the Supreme Court in Trump v. Hawaii.

3. Suspension of Immigrant Visas During COVID-19
In 2020, Presidential Proclamation 10014 temporarily suspended issuance of many new immigrant visas abroad, blocking tens of thousands of prospective permanent residents.

4. H-1B and Other Temporary Work Visa Suspensions
Presidential Proclamation 10052 temporarily halted issuance of new H-1B, H-2B, L-1, and certain J visas from abroad during the pandemic.

5. Increased H-1B Denials and RFEs
USCIS sharply increased Requests for Evidence and denial rates for H-1B petitions, particularly for extension requests and IT consulting firms.

6. Elimination of Interview Waivers
The administration expanded in-person interview requirements for employment-based green cards and many adjustment-of-status applicants, slowing processing considerably.

7. Reduction in Refugee Admissions
Annual refugee ceilings were cut repeatedly, reaching a historic low of 15,000 for fiscal year 2021.

8. Proposed Elimination of H-4 EAD
The administration sought to rescind work authorization for many H-4 spouses, though the rule was never finalized.

9. “Buy American, Hire American” Executive Order
This order directed agencies to rigorously enforce immigration laws and prioritize the “most-skilled or highest-paid” applicants.

10. Expanded Visa Vetting and Administrative Processing
Enhanced security screening increased delays across numerous visa categories.
