I'm certainly no expert and would love to hear from others with experience, but an arrest warrant was not issued until Sept. 23rd. Brian was long gone by then. Is it criminal to help your son disappear when he isn't subject to an arrest warrant? I don't think it is. Even if Brian told them he had a role in Gabby's death I am not sure that rises to the level of a crime. I think the FBI can easily get a warrant for Brian's phone, bank records, etc. and they likely have. But his parents are a degree removed legally speaking. I am certain the FBI is seeking every possible way to charge the parents with something. If Brian stays missing I think they will use 18 USC 1001 - lying to a federal agent to exert pressure.[/quote]
