If it goes to trial, the jury will have the benefit of observing the au pair and maybe even getting her testimony. Where the physical evidence is confusing or limited, I think her presence, manner and possibly testimony will help the jury tremendously on whether to convict or not. [/quote]

ETA I hope she does testify, because then she’ll have to answer the prosecution’s questions on her insane behavior -

Why did you assume a car parked in the driveway = a home invasion?

Why did you take a child inside the house?

Why did you leave the child to walk toward the room with screaming and shouting, instead of calling 911 and leaving the house?

Why did you hang up on 911 when we can hear a man moaning in the background?

When did you decide to become Mommy 2.0?
