Issues also arise in the course of arguing a motion which lead to the judge announcing a preliminary intention of how she will rule but inviting additional briefing from the litigants. The chef’s kiss in this morning’s DOJ filing is telling Judge Cannon that they explicitly complied with what Judge Reinhart had authorized in issuing the warrant. Tantamount to a checkmate. They couldn’t even be bothered to prepare a summons of file a proper complaint invoking the court’s subject matter jurisdiction over a “miscellaneous” proceeding. [/quote] Exactly, so arguments about TROs are irrelevant. A TRO motion has specific requirements because it is ex parte, including an affidavit showing irreparable harm (and judge has to find that) as well as reasonable efforts to notify the defendant. Trump could not possibly meet these requirement after waiting two weeks after the search to do anything at all, and they didn't even try. A TRO also usually requires posting a bond.[/quote]
