The activist justices will again cherry-pick instances where there were no such restrictions and strike them down, one-by-one, just like they read “well-regulated militia” out of the Bill of Rights. Not even Robert Bork himself took that position. Did you need a background check to purchase a musket in 1790? Nope. Then it’s unconstitutional. Did you have to demonstrate proficiency and was training required? Nope. Then it’s unconstitutional. I get it’s cool to play the victim but it was Heller that moved the goalposts after 200+ years. SCOTUS has kept moving them.
