You can't just take the gen ed teacher off their summer school assignment and switch them to special ed. They're not certified for that and most of the students who qualify for ESY have IEPs stating that classroom instruction will be from a special ed teacher. Also, if you did that to the gen ed teachers or they knew it could happen, you'd get even less gen ed teachers volunteering for summer school, so then you'd end up with BOTH programs not staffed.
