I know the penalty under the ACA was justified as a tax which is how you can get around constitutionality issues with having a penalty, but I doubt there is a constitutional way to force someone to buy insurance (which is what assigning an insurer and charging back-premiums amounts to). At best, I think, you can have a higher penalty that makes it financially non-sensical to not buy insurance.[/quote]
