It is legal to conduct business meetings and train employees on visitor visas, which is what they were doing. I know, because we are foreigners and my husband has been asked to do this, and our attorney confirmed it was legal. So yes, ICE was lying.[/quote]

Well, this was a clusterf*** for sure, but whether the Koreans had the right visas is less clear cut:

I think it was a wink-wink nudge nudge grey area given the fact that the "right" visa flat out does not exist, and the Koreans were as close to compliance as they could possibly be within the visa system, and while conducting activities that will create US jobs. Shackling them, the treatment they received in detention, all of that was well beyond the pale and is going to have a generation's worth of impact on Korean impressions of the United States, and willingness to do business with us.

This is not a total digression from the Eastern MS case, to be honest. Just as immigration officials had the option to pursue the Korean case with some discretion, they also had the option not to attempt to apprehend these two guys in front of a middle school.
